A question we often get from our landlords and property owners is: will we ever have an eviction? As your property managers, we really can’t tell you yes or no. Evictions can happen to anyone, but we don’t know if it will happen to you.
Rent Collection
Part of the process in avoiding eviction is the collection of rent. When we don’t get rent from our tenants, we contact them. Our policy is to send out a notice to the tenants after rent is due, and we ask them to contact us. If they don’t contact us, we try to call them and do what we can to get in touch. When our attempts at communication fail, we have to file for eviction.
Eviction Process
This process can be very time consuming and very expensive. That’s why it’s essential that you don’t delay the process. Make it a priority. After filing for eviction, you’ll get a court date. You have to go to court and present your case to the judge. If the tenant shows up, they have the opportunity to present their case as well. If you’re evicting for nonpayment of rent, you are pretty much guaranteed to win.
Writ of Possession
Five days after you are awarded the property, you need to go and inspect it to see if it’s still occupied. If the tenants are still there, you have to file what the state of Texas calls a Writ of Possession. With the Writ, there is a fee. A constable from the County comes out to the property on a scheduled date and time and removes the individual from the property. If the tenant’s belongings are still in there, you’ll need to hire a crew to pack up the belongings and remove them from your property. Those belongings will be placed on the curb, and 24 hours later, the crew must verify that the belongings are gone. If they have not been removed, the crew will load them up from the curb and dispose of them. Those things are considered trash after 24 hours.
A good way to avoid eviction is through communication with the tenants at all times and thorough tenant screening. During the screening process, check credit, criminal history, eviction records and rental history.
